Orders and Returns

What to do if there's a problem with your order

1. ORDERS

1.1 Placing Orders

You may place orders for Goods and Services by:
(a) completing a purchase order form and sending or faxing it to Illycaffe;
(b) telephone;
(c) online via the Australian pages of www.illy.com.au; or
(d) in person at an Illycaffe store.

1.2 Minimum Order Quantities

When ordering Illycaffe capsules or 250g products, each order must be in multiples of 6 tins (1 carton).

1.3 Availability

All orders are subject to stock availability and minimum/maximum quantities as determined by Illycaffe from time to time.

1.4 Stock Limits

Illycaffe offers its products on this website within the limits of available stock.

1.5 Right to Refuse Orders

Illycaffe reserves the right to refuse any order, in whole or in part, at its absolute discretion.


2. RETURNS

2.1 Order Verification and Notification

You must verify your order of Goods upon delivery and notify Illycaffe within seven (7) days of receipt of any incorrect order. If required by Illycaffe, such Goods forming part of the incorrect order must be promptly returned by you to Illycaffe.

2.2 Condition of Returned Goods

Illycaffe will only accept returns of unused Goods in their original condition, in their original packaging and/or in protective packaging that prevents damage in transit. Goods returned damaged or not adequately protected during return shipping will not be accepted and will not be eligible for a refund or store credit.

2.3 Reimbursement

When returns are properly completed and approved, Illycaffe will reimburse the price of the returned Goods and the invoiced delivery charges within thirty (30) days of receipt of the returned Goods.

2.4 Delivery Dates

You cannot refuse to accept Goods merely because they are not delivered by any given date or dates.

2.5 Promotional Purchases

If items are purchased as part of a promotion, all items included in the promotion must be returned together to be eligible for a refund or store credit.


3. DELIVERY AND RECEIPT

3.1 Delivery

Illycaffe will endeavour to provide Goods and Services in a timely manner to the address specified in your order. However, Illycaffe will not be liable for:
(a) any failure to deliver or delay in delivery for any reason;
(b) any damage or loss due to unloading or packaging; or
(c) damage to property caused upon entering premises to deliver the Goods or provide the Services.
Any costs incurred by Illycaffe due to your failure to accept the Goods at the time of delivery must be reimbursed by you to Illycaffe.

3.2 Freight and Delivery Charges

Invoices for Goods may include a flat rate charge for freight and delivery, as indicated in the checkout section of the website.

3.3 Alternative Delivery Arrangements

If you wish to have Goods or Services provided by means other than Illycaffe’s usual methods, you must make all necessary arrangements and pay all associated costs.


4. PAYMENT AND INTEREST

4.1 Price Changes

Illycaffe may change the price of Goods and Services at any time without notice.

4.2 Payment Terms

You must pay the price of Goods and Services current at the time of payment or at the time of dispatch of the Goods or provision of the Services, whichever is earlier.

4.3 Invoice Payment

Invoices are payable on or before dispatch of Goods or provision of Services. Time is of the essence for all payments to Illycaffe under this agreement.

4.4 GST

You must pay Illycaffe any GST payable for the provision of the Goods and Services.

4.5 Duties and Taxes

You are responsible for all duties, taxes, and clearance charges that may be levied on the Goods.


5. TITLE AND RISK

5.1 Title

Title in Goods passes to you upon payment in full.

5.2 Risk

Risk in Goods passes to you upon delivery of the Goods to you, unless you arrange for delivery, in which case risk passes when the Goods leave Illycaffe’s premises.
